To enter draw comment on the Courtyard by Marriott post on the Courtyard by Marriott Facebook page with #CourtyardFCBayern, telling us which friend or family member you want to share the overnight stay with and which other ten (10) people (friends and/or family members - do not tag the people) you would like to share the experience (prize) with. Prizes (11 in total): 10 x runners up prizes - one (1) official FC Bayern scarf merchandise and 1x first prize - one one-night stay for two people in the Courtyard by Marriott Suite at the Allianz Arena, Munich on 11th May 2018 (no breakfast included), and 12 (twelve) VIP tickets in premium seats with access to the Courtyard by Marriott Suite at the Allianz Arena on 12th May 2018. Fixed Dates. No travel included in prize and no accommodation for the ten (10) friends who receive 10 (ten) VIP tickets in in premium seats. These are the terms and conditions (the “Terms and Conditions”) that govern the relationship between you, the entrant (“you”, “your(s)”) and the promoter of the Promotion, Marriott Hotels International Limited, Barnard’s Inn, 86 Fetter Lane, London EC4A 1EN, United Kingdom (the “Promoter”, “we”, “our”, “us”) and EchoMany Limited of EchoMany, 47 Duke Street, Henley-onThames, RG9 1UR, United Kingdom (the "Administrator") in relation to the Promotion.
These Terms and Conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. Entry and claim instructions are deemed to form part of the terms and conditions. Please retain a copy for your information.
All information provided by you in connection with this Promotion is provided to us directly and not to Facebook and this Promotion is in no way sponsored, endorsed or administered by, or associated with Facebook. For the avoidance of doubt, Facebook, shall have no responsibility or liability to you in respect of the Promotion.
ELIGIBILITY
1.The Promotion is only open to individuals who are residents in Germany or the United Kingdom aged eighteen (18) or over who have internet access, a valid and active Facebook profile / account with valid and active access to the Facebook messenger function.
2.The following are not eligible to participate in this Promotion: (i) employees of the Promoter and the Administrator, their respective parents, affiliates, direct and indirect subsidiaries and associated companies, their franchisees, representatives, consultants, contractors, legal counsel, agencies, web site providers, web masters, their advertising, public relations, and promotional, fulfilment and marketing agencies or the prize suppliers, and each of their respective shareholders, partners, members, officers, directors, agents, representatives and employees (collectively, the “Promotion Entities”); and (ii) immediate family members of such employees or of anyone with whom such employees are domiciled. In these Terms and Conditions, “immediate family” includes mother, father, brothers, sisters, sons, daughters, partner or spouse.
3.By entering the Promotion you confirm that you have legal capacity to enter the Promotion and agree to the Terms and Conditions (i.e. that you are of sufficient age and mental capacity, are resident in Germany or the UK and are entitled to be legally bound in contract). The Promoter reserves the right to verify your eligibility.
ENTRY PERIOD
4.The Promotion will run from 10:00am Greenwich Mean Time (GMT)/11:00am Central European Time (CET) on 22 March 2018 to 14:00pm (GMT)/15:00pm (CET) on 16 April 2018 (the “Entry Period”).
HOW TO ENTER
5.To participate in the Promotion you will need to do the following during the Entry Period:
a.Visit the @courtyard Facebook page located at https://www.facebook.com/courtyard/ ("Facebook Page");
b.Access the relevant Courtyard by Marriott competition post on the Facebook Page titled Sleepover Competition #CourtyardFCBayern prize draw ("Promotion Post");
c.View the terms and conditions accompanying the Promotion Post and only enter if you are eligible and agree to all terms and conditions;
d.Comment on the Promotion Post as instructed, including the hashtag #CourtyardFCBayern, and telling us which friend or family member you want to share the overnight stay with and which other ten (10) people (friends and/or family members) you would like to share the experience (prize) with. Please do not tag these people;
("Entry").
The hashtag #CourtyardFCBayern must be used within the comment to be classed as an Entry. You will then be automatically entered into the prize draw for the Promotion. Once you have posted your comment, you will automatically be served with a Facebook message acknowledging your Entry, together with a personalized video created by the Administrator of a Bayern Munich football team sheet featuring your name and the name of the friend or family member you want to share the overnight stay with ("Personalised Team Sheet").You can download and share the Personalised Team Sheet if you want to, but it is not a condition of Entry.
6.Maximum one (1) Entry per person, regardless of the number of comments made during the Entry Period. Anyone trying to circumvent this rule by using alternative details including but not limited to creating multiple accounts will be disqualified from this Promotion. Entries (bulk or otherwise) made from trade, consumer groups or third parties will not be accepted. If it becomes apparent that you are reposting the same content multiple times or using a computer(s) to circumvent this condition by, for example, the use of ‘script’, ‘brute force’ or any other automated means, that person’s Entries will be disqualified and any prize award will be void.
7.The Promoter monitors responses to this Promotion and if any responses or any previous posts made by you are, or could be regarded, as being disrespectful towards other members of the Facebook community or which contain anything which is likely to, or could cause offence or distress, they will be removed from the Promotion and we reserve the right to disqualify you from the Promotion. As someone who enters the Promotion, your use on Facebook is subject to the platform’s terms and conditions.
8.By entering the Promotion and submitting an Entry you agree that such Entry, with the exception of personally identifiable information as identified in the Promoter's privacy policy available at http://www.marriott.co.uk/marriott/privacy-uk.mi and the Administrator's privacy policy available at https://echomany.com/privacypolicy/is deemed to be non-confidential and non-proprietary, and the Promoter shall have no obligation of any kind with respect to such Entry.
9.By entering this Promotion you agree that we have the right to use your Entry for the purpose of the Promotion. You should not provide any materials or information that you do not want published on Facebook. If you do not wish to share your Entry in this way and/or you do not wish to receive the Personalised Team Sheet, you should not enter this Promotion. You warrant to us that you are the author of your Entry, you have the right to submit it and that it does not infringe the rights of any third party.
10.You shall be solely responsible for the content of your Entry submitted to this Promotion and you agree to indemnify and hold us harmless from and against any liability, claims and demands arising due to wilful or negligent conduct in connection with the content of your Entry submitted to this Promotion.
11.Your Entry will be deemed invalid if any post -
a.contains defamatory, malicious, indecent or other inappropriate content;
b.includes the names of any individual without their express permission;
c.in the reasonable opinion of the Promoter, cause any widespread or serious offense (UK only); or
d.in the reasonable opinion of the Promoter, cause any criminal offense.
PRIZES
12. Prizes: There will be a total of eleven (11) prizes comprised of ten (10) Runners Up prizes and one (1) First Prize as detailed below.
Runners Up Prizes
There will be ten (10) runners up prizes. Each winner will receive one (1) official FC Bayern scarf merchandise.
First Prize
There will be one (1) first prize consisting of one (1) night stay for two (2) people (the winner plus one (1) guest) in the Courtyard by Marriott Suite at the Allianz Arena, Munich (Werner-Heisenberg-Allee 25, 80939 München, Germany) ("Suite") on 11th May 2018 (no breakfast included), and twelve (12) VIP tickets in premium seats with access to the Courtyard by Marriott Suite at the Allianz Arena on 12th May 2018 only to watch the football match FC Bayern v VfB Stuttgart at 14.30 CET on 12th May 2018 at the Allianz Arena, Munich ("Football Match"). 14.The first prize may only be redeemed by the first prize winner himself/herself plus one (1) guest for the one (1) night stay in the Suite and the winner plus ten (11) eleven in total for the Football Match, and the first prize winner may be required to present personal identification documents to prove their identity to the Promoter and the prize suppliers, including at the Suite and Football Match. The first prize winner and his/her guests must be available to attend on the dates specified above. Dates are fixed and cannot be changed. If the first prize winner and their guests cannot attend on such dates, they will forfeit their right to receive the prize. The first prize winner's guests must also be aged eighteen (18) or over (or if younger must be the child of the first prize winner). The first prize winner and his/her guests are solely responsible for arranging travel to the Stadium and the Suite, valid travel documents (i.e. a passport, visa, etc.), travel insurance (and all other forms of insurance) at their option.
15.All other expenses, including without limitation, meals and beverages, all transportation, including to and from airports, hotels and stadiums, gratuities, spending money, personal expenses, souvenirs, incidentals and expenses not expressly specified herein are the sole responsibility of the first prize winner and his/her guests. The first prize only includes the one (1) night stay for the winner himself/herself plus (1) guest for the one (1) night stay at the Suite, but does not include any accommodation for the ten (10) other guests for the Football Match.
16.Each prize may only be redeemed by the winners and must be accepted as awarded and it is non-transferable or convertible to cash or other substitutes.
17.No responsibility is assumed by the Promoter for any cancelled, delayed, suspended or rescheduled events once any tickets have been issued in relation to the prize for any reason whatsoever beyond their control.
18.If due to circumstances beyond our control we are unable to provide the stated prize we reserve the right to award a substitute prize of equal or greater value.
19.GERMANY ONLY - By participating in this Promotion, entrants agree that the Promoter and the Promotion Entities (the “Released Parties”) shall only be liable for wilful intent and gross negligence and for a negligent breach of a substantial obligation. In case of a negligent breach of a substantial obligation the liability of the Released Parties for ordinary negligence shall be limited to the typical and foreseeable damages. This limitation of liability shall not apply to claims for culpable caused damages to life, body and health and to claims arising from the German Act on Product Liability (Produkthaftungsgesetz). Furthermore, the Released Party shall be held harmless by entrants against, any liability for any injuries, losses or damages of any kind (including without limitation, direct, indirect, incidental, consequential, or punitive damages) to persons or property resulting due to wilful or negligent conduct in whole or in part, directly or indirectly, from, possession, misuse, non-use or use of a prize, entry, or participation in this Promotion or in any Promotion related activity, including access to and use of the Promotion Page and websites connected to the Promotion, any travel or travel-related activity or any claims based on publicity rights, defamation or invasion of privacy, or merchandise delivery. No responsibility is assumed by the Released Parties if any prize cannot be awarded due to cancellations, delays, or interruptions due to acts of god, acts of war, natural disasters, weather, or terrorism or for any cancelled, delayed, suspended or rescheduled events once any tickets have been issued in relation to the prize for any reason whatsoever beyond their control.
20.UK ONLY - By participating in this Promotion, entrants agree that the Promoter and the Promotion Entities (the “Released Parties”)will (except in relation to claims for personal injury or death caused) have no liability for, and shall be held harmless by entrants against, any liability for any injuries, losses or damages of any kind (including without limitation, direct, indirect, incidental, consequential, or punitive damages) to persons or property resulting in whole or in part, directly or indirectly, from, possession, misuse, non-use or use of a prize, entry, or participation in this Promotion or in any Promotion related activity, including access to and use of websites connected to the Promotion, or any claims based on publicity rights, defamation or invasion of privacy.
WINNER SELECTION AND NOTIFICATION
21.The prize draw (the “Prize Draw”) will take place at the premises of the Promoter by 16.00pm (GMT)/17.00pm (CET) on 16th April 2018. There will be one draw in total. The winners will be selected electronically via randomised computer process from all valid and eligible Entries received during the Entry Period in accordance with these Terms and Conditions. The first name to be drawn will be the first prize winner and the subsequent ten (10) names to be drawn will be the runners up prize winners.
22.We will notify the winners by Facebook comment function in reply to the Promotion Post by 11.00am (GMT)/12.00 (CET) on 17th April 2018.To redeem the prize, the winners will be required to confirm their acceptance of the prize by sending a direct message by Facebook messenger function to @courtyard and provide their First name, Last name, telephone number, postal address and email address by 11.00am (GMT)/12.00 (CET) on 19th April 2018, ("Confirmation").
23.Following receipt of the Confirmation from the first prize winner, the Promotor will liaise with the first prize winner to confirm the first prize winner's reservation in the Suite and tickets. The Promotor will send an email to the first prize winner confirming the reservation in the Suite and the first prize winner must collect the football match tickets in the Courtyard by Marriott Suite at the Allianz Arena, Munich from 15.00 CET on 11th May 2018. Following receipt of the Confirmation from the runners up prize winners, Marriott will send the runners up prizes to the runners up prize winners' postal address within 30 days of the Confirmation.
24.We reserve the right to select alternative winners in the event that:
a.a winner cannot be notified after two (2) attempts within the timeframe specified at rule 22 above; and/or
b.a winner does not confirm their acceptance of their prize by 11.00 (GMT)//12.00 (CET) on 19th April 2018; and/or
c. we have reasonable grounds for believing that a winner had contravened any of these Terms and Conditions and/or the terms and conditions of Facebook; and/or
d. a winner is unable to accept the prize.
25.The winners and their home cities will be available for one (1) month after the end of the Entry Period by sending an email to FCB@marriott.com
GENERAL
26.The Promoter reserves the right to verify all Entries including but not limited to asking for address and identity details and to refuse to award a prize or withdraw prize entitlement and/or refuse further participation in the Promotion and disqualify you where there are reasonable grounds to believe there has been a breach of these terms and conditions or any instructions forming part of this Promotion's entry requirements or otherwise where you have gained unfair advantage in participating in the Promotion or won using fraudulent means.
27. By participating in the Promotion, you agree to be bound by these Terms and Conditions (which may be amended or varied at any time by us with or without notice in accordance with rule 28) and by our decisions, which are final in all matters relating to these Terms and Conditions, the Promotion and/or the results and no correspondence or discussion shall be entered into.
28.All changes to the Terms and Conditions will be posted in revised terms and conditions on https://promotions.marriott.co.uk/cyfcbtc and notified to you if you have entered the Promotion prior to such revisions. You have the right to cancel your participation in the Promotion should you not agree with the amended Terms and Conditions. In the event that the Terms and Condition are amended or varied by us you have the right to cancel your participation in the Promotion should you not agree with the amended Terms and Conditions.
29.If for any reason any aspect of this Promotion is not capable of running as planned, including by reason of infection by computer virus, network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this Promotion, the Promoter may in their sole discretion modify or suspend the Promotion or invalidate any affected Entries/claims. If an act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these Terms and Conditions the Promoter will not be liable for any failure to perform or delay in performing their obligations. In either of such circumstance, the Promoter will select the winners from all valid and eligible Entries received at the time of such early termination.
30.We accept no responsibility for any incorrect or inaccurate information, ineligible, incomplete, lost or late Entries, and assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, line failure, theft or destruction or unauthorised access to Entries lost or delayed whether or not arising during operation or transmission as a result of server functions, or for technical, network, telephone equipment, electronic, computer hardware or software malfunctions, virus, bugs or other causes outside their control (to the fullest extent permitted by law) or failure to receive Entry information by us on account of technical problems or traffic congestion affecting the entry collection process.
31.If not stated otherwise in these Terms and Conditions, personal information collected from entrants about entrants will be incorporated in computerised files belonging to us, and will be used by us and the Administrator solely in connection with the Promotion and will not be disclosed to any third party except for the purpose of operating the Promotion and fulfilling prizes where applicable in accordance with the respective privacy policy and in accordance with all applicable data protection and privacy laws. Each Entrant has the right to access, correct or delete the information collected and/or processed by us about himself/herself. Entrants may exercise this right by simple written request sent to FCB@marriott.com. Entrants may exercise rights of access, cancellation and correction of their personal data and object to the processing thereof by sending an email to FCB@marriott.com.
32.GERMANY ONLY - By entering this Promotion, if you are declared a winner we may ask you to submit a digital photograph of yourself, and you and your guests each agree to let us use your name, country of origin and/or the digital photograph of yourself submitted by you if you are a declared winner in all media and formats whether now or later known or developed, without any time or territorial limit and without further notice or compensation. The winners also agree to participate in promotions that the Promoter deem appropriate for the promotion of this Promotion.
33.UK ONLY - By entering this Promotion, if you are declared a winner we may ask you to submit a digital photograph of yourself, and you and your guests each agree to let us use your name, biographical information, country of origin and/or the digital photograph of yourself submitted by you if you are a declared winner in all media and formats whether now or later known or developed, without any time or territorial limit and without further notice or compensation. The winners also agree to participate in publicity events without additional compensation (save for reasonable travel expenses) that the Promoter deem appropriate for the promotion of this Promotion.
34.If any of these rules should be determined to be illegal, invalid or otherwise unenforceable then it shall be severed and deleted from these terms and conditions and the remaining clauses shall survive and remain in full force and effect.
35.These Terms and Conditions shall be governed by and construed in accordance with English law and any dispute arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the English Courts.
36.Neither Marriott Hotels Internal Limited nor any of parents, affiliates, direct and indirect subsidiaries and associated companies, including without limitation, Marriott International, Inc. shall be liable for technical, pictorial, typographical or editorial errors or omissions contained herein.
