MARRIOTT NFL PRIZE DRAW ("Promotion")
TERMS AND CONDITIONS
These are the terms and conditions (the “Terms and Conditions”) that govern the relationship between you, the entrant (“you”, “your(s)”) and Marriott Hotels International Limited incorporated and registered in England and Wales with company number 01673907 whose registered office is at 4th Floor, 45 Monmouth Street, London, England, WC2H 9DG (the “Promoter”, “we”, “our”, “us”) and ignis agency, ignis ltd, 374 North End Road, Fulham, London, SW6 1LY (the "Administrator") in relation to the Promotion.
All information provided by you in connection with this Promotion is provided to us directly and not to Facebook and this Promotion is in no way sponsored, endorsed or administered by, or associated with Facebook. For the avoidance of doubt, Facebook, shall have no responsibility or liability to you in respect of the Promotion.
ELIGIBILITY
1.The Promotion is only open to residents in England and Wales aged eighteen (18) or over who have internet access, a valid and active Facebook profile / account with valid and active access to the Facebook messenger function.
2.The following are not eligible to participate in this Promotion: (i) employees of the Promoter, its parents, affiliates, direct and indirect subsidiaries and associated companies, its franchisees, representatives, consultants, contractors, legal counsel, agencies, web site providers, web masters,its advertising, public relations, and promotional, fulfilment and marketing agencies or the prize suppliers, including without limitation employees of NFL, airlines selected by the Promoter, and each of their respective direct and indirect subsidiaries and affiliates, and each of their respective shareholders, partners, members, officers, directors, agents, representatives and employees (collectively, the “Promotion Entities”)(ii) immediate family members of such employees or of anyone with whom such employees are domiciled. In these Terms and Conditions, “immediate family” includes mother, father, brothers, sisters, sons, daughters, partner or spouse.
3.By entering the Promotion you confirm that you have legal capacity to enter the Promotion and agree to the Terms and Conditions (i.e. that you are of sufficient age and mental capacity and are entitled to be legally bound in contract). The Promoter reserves the right to verify your eligibility.
ENTRY PERIOD
4.The Promotion will run from 18:00pm Greenwich Mean Time (GMT) on 10th October 2018 to 11.59pm (GMT) on 14th January 2019 (the “Entry Period”).All Promotion entries received after the expiry of the Entry Period are automatically disqualified.
HOW TO ENTER
5.To participate in the Promotion you will need to do the following during the Entry Period:
a.Visit the @courtyard Facebook page located at https://www.facebook.com/courtyard/ ("Facebook Page");
b.Access the Courtyard by Marriott competition post on the Facebook Page giving you the chance to win x2 tickets to Super Bowl LIII by asking you to comment how far would you go to get to the Super Bowl? #CourtyardNFL prize draw ("Promotion Post");
c.View the terms and conditions accompanying the Promotion Post and only enter if you are eligible and agree to all terms and conditions;.ccept
d.Comment on the Promotion Post as instructed, including the hashtag #CourtyardNFL, and telling us how far you would go to get to the SuperBowl.
(“Entry”)
6.The hashtag #CourtyardNFL must be used within the comment to be classed as an Entry. You will then be automatically entered into the prize draw for the Promotion.
7. No purchase is necessary to enter the Promotion.
8.Maximum one (1) Entry per person, regardless of the number of comments made during the Entry Period. Anyone trying to circumvent this rule by using alternative details including but not limited to creating multiple accounts will be disqualified from this Promotion. Entries (bulk or otherwise) made from trade, consumer groups or third parties will not be accepted. If it becomes apparent that you are reposting the same content multiple times or using a computer(s) to circumvent this condition by, for example, the use of ‘script’, ‘brute force’ or any other automated means, any such Entries will be disqualified and any prize award will be void.
9.The Promoter monitors responses to this Promotion and if any responses or any previous posts made by you are, or could be regarded, as being disrespectful towards other members of the Facebook community or which contain anything which is likely to, or could cause offence or distress, they will be removed from the Promotion and we reserve the right to disqualify you from the Promotion. As someone who enters the Promotion, your use on Facebook is subject to the platform’s terms and conditions.
10.Your Entry will be deemed invalid if any post -
a.contains defamatory, malicious, indecent or other inappropriate content;
b.includes the names of any individual without their express permission;
c.in the reasonable opinion of the Promoter, cause any widespread or serious offense (UK only); or
d.in the reasonable opinion of the Promoter, cause any criminal offense.
PRIZE
11. There will be a total of one (1) prize comprised of the following elements. The winner will receive:
Two (2) return economy flights from London to Atlanta with an airline selected by the Promoter at its absolute discretion. Departure and arrival airport to be chosen at the Promoter's sole discretion. Please note that flight times may be subject to changes and/or delays.One (1) room (double or twin occupancy) for three (3) nights on a room only basis in a Marriott owned hotel on 1st February 2019 – 4th February 2019.Two (2) standard tickets for the SuperBowl LIII in Atlanta on 3rd February 2019.12.The prize must be accepted as awarded and is non-transferable or convertible to cash or other substitutes and cannot be used in conjunction with any other vouchers, offers or discounts, including without limitation any vouchers or offers of the Promoter and/or NFL, Marriott Hotels and other prize suppliers.
13.The prize may only be redeemed by the winner himself/herself plus one (1) guest and the winner may be required to present personal identification documents to prove their identity to the Promoter and the prize suppliers. The winner and his/her guest must be available to travel on the dates specified above. Travel plans are fixed and cannot be changed. If winner and their guests cannot travel on such dates, they will forfeit their right to receive the prize.
14.If due to circumstances beyond our control we are unable to provide the stated prize, we reserve the right to award a substitute prize of equal or greater value.
15.All other expenses, including without limitation, meals and beverages, transportation to and from airports, hotels and stadiums, gratuities, spending money, personal expenses, souvenirs, incidentals and expenses not expressly specified herein are the sole responsibility of the winner and their guests.
16.The winner and their guest will be responsible for ensuring travel insurance and travel papers, including passports and visas and are valid prior to and for the duration of the trip. It is strongly recommended that travellers take out adequate travel insurance.
17.The winner must comply with the terms and conditions of any tickets awarded and the safety and security policies of any venue at which the events are held.
18.No responsibility is assumed by the Promoter for any cancelled, delayed, suspended or rescheduled events once any tickets have been issued in relation to the prize for any reason whatsoever beyond its control.
19.The prize airline tickets are valid for flights originating in UK going to Atlanta and on flights operated by an airline selected by the Promoter at its absolute discretion. Tickets may not be transferred to any other airline than the one selected by the Promoter. Flights are as selected by the Promoter. Prize winner to liaise with the Promoter to confirm details of flights and hotel.
20.The winners and their guests must abide by and are subject to any terms and conditions including any published Conditions of Carriage of the airline selected by the Promoter.
21.The winner must travel on the same flight and on the same date as their guests as specified above.If the winner wish to travel alone, the second ticket will be forfeited.
22.No airline miles will be awarded for travel on the prize tickets.
23.By participating in this Promotion, entrants agree that the Promoter and the Promotion Entities (the “Released Parties”) will (except in relation to claims for personal injury or death caused) have no liability for, and shall be held harmless by entrants against, any liability for any injuries, losses or damages of any kind (including without limitation, direct, indirect, incidental, consequential, or punitive damages) to persons or property resulting in whole or in part, directly or indirectly, from, possession, misuse, non-use or use of a prize, entry, or participation in this Promotion or in any Promotion related activity, including access to and use of websites connected to the Promotion, or any claims based on publicity rights, defamation or invasion of privacy, or merchandise delivery. No responsibility is assumed by the Released Parties if the prize cannot be awarded due to cancellations, delays, or interruptions due to acts of god, acts of war, natural disasters, weather, or terrorism or for any cancelled, delayed, suspended or rescheduled events once any tickets have been issued in relation to the prize for any reason whatsoever beyond its control.
WINNER SELECTION AND NOTIFICATION
24.The prize draw (the “Prize Draw”) will take place at the Promoter's offices within two (2) business days after the end of the Entry Period. The winner will be selected electronically at random from all valid and eligible Entries received during the Entry Period in accordance with these Terms and Conditions. The first one (1) Entry selected will win the First Prize.
25.We will endeavour to notify the winner by the Facebook Messenger Chat function, after the end of the Entry Period by 16th January 2019 and the winner will be required to confirm his/her acceptance of the prize in writing by sending a direct message by Facebook messenger function to @courtyard and provide their First name, Last name, telephone number, postal address, email address, date of birth and photo by 11.00am (GMT) on 21st January 2019, ("Confirmation").
26.Following receipt of the Confirmation from the prize winner, the Promotor will liaise with the prize winner to confirm the prize winner's reservations and tickets. The Promotor will send an email to the prize winner confirming the reservations of hotel, flight and SuperBowl tickets.
27.We reserve the right to select an alternative winner in the event that:
(a)the prize winner cannot be contacted after two (2) attempts within three (3) business days of the Prize Draw date;
(b)the prize winner does not confirm their acceptance of their prize by 11.00am (GMT) on 21st January 2019; and/or
(c)we have reasonable grounds for believing that the prize winner has contravened any of these Terms and Conditions and/or the terms and conditions of Facebook; and/or
(d) the prize winner is unable to accept the prize.
28.The prize winner’s details and his/her home county will be available for one (1) month after the end of the Entry Period by sending an email to FCB@marriott.com.
GENERAL
29.By participating in the Promotion, you agree to be bound by these Terms and Conditions (which may be amended or varied at any time by us with or without notice) in accordance with rule 30, the terms and conditions of any tickets awarded and by our decisions, which are final in all matters relating to these Terms and Conditions, the Promotion and/or the results and no correspondence or discussion shall be entered into.
30.All changes to the Terms and Conditions will be posted in revised terms and conditions https://promotions.marriott.co.uk/nfl18terms and notified to you if you have entered the Promotion prior to such revisions. You have the right to cancel your participation in the Promotion should you not agree with the amended Terms and Conditions. In the event that the Terms and Condition are amended or varied by us you have the right to cancel your participation in the Promotion should you not agree with the amended Terms and Conditions.
31.If for any reason any aspect of this Promotion is not capable of running as planned, including by reason of infection by computer virus, network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this Promotion, the Promoter may in their sole discretion modify or suspend the Promotion or invalidate any affected Entries/claims. If an act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these Terms and Conditions the Promoter will not be liable for any failure to perform or delay in performing their obligations. In either of such circumstance, the Promoter will select the winner from all valid and eligible Entries received at the time of such early termination.
32.Please note that this Promotion is in no way sponsored, endorsed or administered by, or associated with Facebook. By entering into this Promotion, you acknowledge that Facebook have no responsibility for this Promotion and, to the maximum extent permitted by law, you release Facebook from any liability whatsoever in connection with this Promotion.
33.To the extent permitted by applicable law, all Entries become our property and will not be returned.
34.We accept no responsibility for any incorrect or inaccurate information, ineligible, incomplete, lost or late Entries, and assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, line failure, theft or destruction or unauthorised access to Entries lost or delayed whether or not arising during operation or transmission as a result of server functions, or for technical, network, telephone equipment, electronic, computer hardware or software malfunctions, virus, bugs or other causes outside its control (to the fullest extent permitted by law) or failure to receive Entry information by us on account of technical problems or traffic congestion affecting the entry collection process.
36. The Promoter will process your personal information as set out in the http://www.marriott.co.uk/marriott/privacy-uk. Click http://www.marriott.co.uk/marriott/privacy-uk for the Promoter’s Privacy Policy. By participating in the Promotion, you agree to the use of your personal data as described here.
36.By entering this Promotion, if you are declared a winner we may ask you to submit a digital photograph of yourself, and you and your guests each agree to let us use your name, biographical information, country of origin and/or the digital photograph of yourself submitted by you if you are a declared winner in all media and formats whether now or later known or developed, without any time or territorial limit and without further notice or compensation. The winners also agree to participate in publicity events without additional compensation (save for reasonable travel expenses) that the Promoter deem appropriate for the promotion of this Promotion.
37.NFL and any airline selected by the Promoter will have no liability or responsibility to the entrant for any claim arising in connection with participation in this Promotion or any prize awarded.
38.If any of these rules should be determined to be illegal, invalid or otherwise unenforceable then it shall be severed and deleted from these terms and conditions and the remaining clauses shall survive and remain in full force and effect.
39.These Terms and Conditions shall be governed by and construed in accordance with English law and any dispute arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the English Courts.
40.Neither Marriott Hotels International Limited nor any of parents, affiliates, direct and indirect subsidiaries and associated companies, including without limitation, Marriott International, Inc. shall be liable for technical, pictorial, typographical or editorial errors or omissions contained herein.
